Tally is a subscription service for construction site sign-in and emergency accountability, provided by TALLY SITE SYSTEMS of Alberta, Canada. It records who is on a site, supports emergency muster roll calls, and keeps the safety records that follow.
Tally is a tool, not a safety program and not a substitute for supervision. It does not make a workplace safe, does not discharge any legal duty an employer owes its workers, and does not replace a health and safety management system, an emergency response plan, or a competent person on site. During an emergency, follow your own emergency procedures — Tally supports the roll call, it does not conduct it.
Tally is not a timekeeping or payroll system and should not be used to calculate pay.
Where Tally reports on readiness for a safety audit, it summarises records the customer has entered. It does not audit, certify, or predict an audit result, and no certifying body endorses it.
Your records are yours. Sign-ins, orientations, inspections, incidents and every other record entered by you or your workers remain your property. You can export them at any time, and you keep them if the subscription ends. The software itself, and everything in it that is not your data, remains ours.
We aim to keep the service running continuously and monitor it automatically, but we do not promise uninterrupted availability, and no uptime guarantee applies unless one is written into a signed agreement. Sign-in continues to work on a worker's phone without a network connection and syncs when coverage returns.
Subscriptions are billed monthly per active site, as set out in your agreement. Text messages sent on your behalf are passed through at cost. Prices may change with at least 30 days' notice; changes never apply to a period you have already paid for.
You may end the subscription at any time with 30 days' notice, and export everything before you go. We may end it for non-payment or misuse, with notice and a reasonable chance to put it right. If we ever discontinue the service, you will get notice long enough to export your records and make other arrangements — measured in months, not days.
The service is provided as-is to the extent the law allows. We are not liable for indirect or consequential losses, and our total liability in any twelve-month period is limited to the fees you paid us in that period. Nothing here limits liability that cannot lawfully be limited.
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there.
